This Privacy Policy applies to all personal information collected by Bang Event Co via the website located at bangeventco.com.au.

1. What is "personal information"?

(a) The Privacy Act 1988 (Cth) currently defines "personal information" as meaning information or an opinion about an identified individual or an individual who is reasonably identifiable:
(i) whether the information or opinion is true or not; and
(ii) whether the information or opinion is recorded in a material form or not.

(b) If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as "personal information" and will not be subject to this privacy policy.

2. What information do we collect?

The kind of personal information that we collect from you will depend on how you use the website. The personal information which we collect and hold about you may include: email address, name, phone number, address.

3. How we collect your personal information

(a) We may collect personal information from you whenever you input such information into the website.

(b) We also collect cookies from your computer which enable us to tell when you use the

website and also to help customise your website experience. As a general rule, however, it is not possible to identify you personally from our use of cookies.

4. Purpose of collection

(a) The purpose for which we collect personal information is to provide you with the best service experience possible on the website.

(b)We customarily disclose personal information only to our service providers who assist us in operating the website. Your personal information may also be exposed from time to time to maintenance and support personnel acting in the normal course of their duties.

(c) By using our website, you consent to the receipt of direct marketing material. We will only use your personal information for this purpose if we have collected such information direct from you, and if it is material of a type which you would reasonably expect to receive from us. We do not use sensitive personal information in direct marketing activity. Our direct marketing material will include a simple means by which you can request not to receive further communications of this nature.

Australian Privacy Principle 12 permits you to obtain access to the personal information we hold about you in certain circumstances, and Australian Privacy Principle 13 allows you to correct inaccurate personal information subject to certain exceptions. If you have a complaint concerning the manner in which we maintain the privacy of your personal information, please contact us as set out below. All complaints will be considered by Anna

Barnes and we may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.

7. Overseas transfer

Your personal information will not be disclosed to recipients outside Australia unless you expressly request us to do so. If you request us to transfer your personal information to an overseas recipient, the overseas recipient will not be required to comply with the Australian

Privacy Principles and we will not be liable for any mishandling of your information in such circumstances.

Terms and Conditions

1. Conditions of hire

1.1 Upon receipt of the Hirer’s Approval of Quotation and remittance of 30% booking deposit, your Quotation becomes an order. Your

Quotation is valid for 30 days. The Quote and Order are subject to error corrections, including clerical and/or mathematical errors.

1.2 Once paid, your booking deposit is non-refundable, and non-transferrable. There will be no exceptions made for event planners.

1.3 The Hirer is responsible for the selection of items identified on the Quotation/Order.

The owner accepts no responsibility should the Hirer make the wrong selection. We strongly advise you use our online shopping tool

to make and check over your selections.

1.4 Equipment is solely for the Hirer’s use during the hire period at the event location/s specified.

1.5 Hire commences from the time the stock is collected or delivered and is for a period of time agreed by Bang Event Co. Events held

on a Friday, Saturday or Sunday require stock to be returned by 4:00pm on the Monday following the event date unless other

arrangements are agreed upon.

1.6 Equipment not returned on time will be subject to penalty fee’s calculated as follows; 1 day – 10% of order, 2 days – 20% of order, 3

days – 30% of order, 4 days – 40% of order, 5 or more days – 100% of order value will be re-charged.

1.7 Stock must meet satisfactory guidelines of condition and cleanliness following your event. Stock is to be returned in the same

condition it were at time of collection or delivery. Bang Event Co maintains detailed information and photographs on the condition

of equipment at time of hire.

1.8 The hirer agrees that they have received advice on the correct use of equipment and agrees not to use equipment at location, or for

the purpose, different to those disclosed to Bang Event Co at time of hire. The Hirer agrees that they are responsible for the

equipment and liable for any damage, theft, loss, or anything that compromises the integrity of the equipment.

2. Payment

2.1 Payments must be made by electronic transfer to Bang Event Co. A 30% booking deposit is required to secure your booking, and the balance is due 14 days prior to your event date. Some stock will require a Bond to be paid, and declared on the Quotation, refunded at the time of return and subject to inspection of equipment.

2.2 All payments are due in full 14 days prior to hire date specified on Quotation or Invoice. Stock will not be released without full payment.

2.3 All orders placed less than 14 days from event date require full payment to confirm the booking.

2.4 Once paid, your 30% booking deposit is non-refundable. This includes change of mind, change of date, or either full or part

cancellation. Whether within or out of your control. Please note, there are no exceptions for orders cancelled due to the Covid-19

Pandemic.

2.5 To secure your booking, we require your full name, phone number, email address, address and event location for security purposes.

This information is protected by our Privacy Policy and is under no circumstances shared. An order might not be confirmed or

equipment not supplied until and unless required security details are supplied to Bang Event Co.

3. Canellations

3.1 The Hirer may cancel an order but may forfeit fees as follows.

Cancellations 30 days prior to your booking will be eligible for a refund, less the booking deposit and administration fee of $50.00.

Cancellations within 30 days of your booking will be refunded any delivery/collection fees only due to loss of opportunity.

4. Delivery and Collections

4.1 Delivery charged are at cost only and not for profit. We remind you that delivery ensures the stock travels safely and the hirer is not

liable for any in-transit damage that may occur, which is less likely with our professional delivery service.

4.2 Delivery and Collections are available on order above $1000 only.

4.3 Delivery’s take place 1-2 days prior to your event date, and Collections 1-2 days after your event date, or the Monday following your

event date (Friday, Saturday or Sunday events).

4.4 A dry-hire service is available for all orders. Pick up’s are available 1-2 days prior to your event date, and items are strictly to be

returned 1-2 days following your event date, or the Monday following your event date (Friday, Saturday or Sunday events).

4.5 Bang Event Co reserves the right to invoice additional charges for delivery is circumstances arise where our drivers are held up on

the Hirer’s behalf and go over the budgeted time frame. Extra charges will be payable for delivery and collection to/from higher or lower levels, providing that lift access is available. If lift access is not available, Bang Event Co reserves its right to deliver/collect at street/carpark level only.

4.6 The Hirer agrees to allow Bang Event Co safe and proper site access for deliveries.

4.7 Trailers, farming trucks and horse floats require authorisation for dry-hire pick ups. We recommend 3-tonne lift trucks or vans

available for hire from AVIS, THRIFTY or HERTZ for collection of items.

4.8 The hirer agrees to use protective blankets, adequate ropes and straps for any transportation of equipment. Blankets are available

to hire, subject to availability.

5. Damage and Liability

5.1 The Hirer is responsible for the equipment from the time of pick up or delivery until return or collection, and liable for any damage

incurred to the equipment during this time. Bang Event Co allows for general wear and tear on equipment, subject to;

(a) Damage or loss resulting from overloading, misuse, incorrect stacking, abuse or improper servicing of equipment.

(b) Damage or loss during transportation by the Hirer, or the Hirer’s representative.

(c) Damage or loss of the equipment from any unknown cause, including disappearance.

(d) Burns, including cigarette or candle burns on any linen napkins, upholstery or other furniture and décor items.

(e) Difficult stains including but not limited to red wine spillages, paddock dust and mud on any linen napkins, upholstery or other

furniture and décor items.

5.2 Equipment should be returned in a reasonably clean condition, that similar of condition of items when received. Please note;

(a) Cutlery is dishwasher safe and is to be returned in a ‘dishwasher clean state’ with all food particles and oil/greasy residue fully

cleaned off, and place in our return boxes.

(b) DIY laundering of napkins is strictly prohibited. Napery is to be placed dirty into return laundry bags for professional in-house

dry cleaning, included in your hire cost.

(c) Tables are to be wiped down of, but not limited to, drink spillages, food and candle wax.

(d) All metal furniture is to be wiped down or similarly cleaned from, but not limited to, mud, dust, grass and dirty rain. Our

equipment is not designed to withstand rain.

(e) Festoon Hire requires any blown or broken globes to be returned in boxes clearly marked ‘BROKEN’. Failure to notify Bang

Event Co will result in a dishonesty fee of $50.00 being applied.

5.3 The Hirer must protect equipment from the elements during full hire period, ensuring equipment is stored in a safe place, under

cover.

5.4 Bang Event Co shall not be liable for any indirect or consequential losses or expenses suffered by the hirer, including but not limited

to, loss of turnover, profits, business or goodwill, or any liability to any other party, or for any loss or damage suffered by the Hirer

under any circumstance.

5.5 Bang Event Co shall not be liable for any loss or damage caused to any person, property, animal or things whatsoever arising from

the use or possession of the equipment during your hire period.

5.6 Any person signing this contract on behalf of the Hirer hereby covenants with Bang Event Co that he/she has the authority of the

Hirer to enter this legally binding contract on the Hirer’s behalf.

5.7 In the case of the equipment being damaged, the Hirer may have the opportunity to seek a better price on damaged equipment,

being a new purchase or repair on the particular item at Bang Event Co’s discretion.

5.8 Although maintaining strict terms, conditions and procedures of hire, Bang Event Co will not accept responsibility in the unlikely

event that stock is unable to be supplied to your event due to stock damage, missing stock or stock not returned on time. If this were

to occur, we will notify you immediately and offer you a full refund on the particular item of stock that is unavailable.

6. Marquee Hire

6.1 Site approval - The hirer must ensure they have gained permission to access the site and has appropriate approval for erecting of marquees and lighting. Any permits are to be arranged by the hirer.

6.2 Access to site – The hirer must ensure there is clear access to the required site. If on arrival at the site, the distance from point of parking to point of assembly is found to be greater than 20 metres a surcharge applies.

6.3 Erecting and dismantling – The hirer is required to provide Bang Event Co with either a plan showing the position in which the equipment is to be erected or set up or the hirer should have a representative on site for that purpose. In absence of both Bang Event Co will erect or set up the equipment as it deems fit.

6.4 The Hirer shall make the Company fully aware of all services and obstructions in the immediate vicinity both above and below the ground that may affect any work to be carried out by the Company. The Company will not be liable or responsible for the location, repair or any liability resulting from damage of such services. The Company will take all possible care to avoid damage of such services.
